Terms of Service

These Terms of Service ("Terms") govern your use of the SmartBite mobile application ("App") operated by SmartBite ("we", "our", "us"). By using the App, you agree to be bound by these Terms.

1. Account Registration

• You must provide a valid email address and create a password to use SmartBite
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to create an account
• One person may not maintain more than one account

2. Free and Premium Plans

Free Plan

• Up to 20 saved recipes
• Up to 8 recipe imports per week (blog/website URLs only)
• Up to 2 recipe translations per day
• Full access to meal planning and shopping list features

Premium Plan

• Monthly: $9.99 USD per month
• Annual: $59.99 USD per year
• Unlimited recipes, imports, and translations
• Video source imports (YouTube, TikTok, Instagram, Pinterest)
• AI recipe generation
• Nutrition analysis

Billing

• Subscriptions are billed through Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage and cancel your subscription in your device's subscription settings
• Refunds are handled by Apple or Google according to their respective refund policies

3. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Upload content that is offensive, harmful, or violates the rights of others
• Attempt to access other users' data or accounts
• Reverse-engineer, decompile, or disassemble the App
• Use automated tools to scrape or extract data from the App
• Circumvent usage limits or subscription restrictions
• Share your account credentials with others
• Upload malicious content or attempt to compromise the service

4. Your Content

• You retain ownership of all recipes, images, and other content you create in SmartBite
• By making a recipe public (community sharing), you grant other SmartBite users a non-exclusive right to view and save a copy of that recipe
• You may unpublish a community recipe at any time, but copies already saved by other users will remain in their libraries
• You are responsible for ensuring you have the right to use any content you upload or import

5. AI-Generated Content

• SmartBite uses artificial intelligence (Google Gemini and xAI Grok) to import, generate, analyze, and translate recipes
• AI-generated content is provided "as is" and may contain inaccuracies
• We do not guarantee the accuracy of nutritional information, ingredient quantities, cooking instructions, or any other AI-generated content
• You should always verify AI-generated recipes, especially regarding allergens, dietary restrictions, and food safety
• SmartBite is not a substitute for professional nutritional or medical advice

6. Recipe Import

• The recipe import feature extracts recipe data from publicly accessible URLs
• We do not claim ownership of imported recipe content — original copyright belongs to the source
• Imported recipes are stored in your personal library for personal use
• You are responsible for complying with the terms of the websites you import from

7. Service Availability

• We strive to keep SmartBite available 24/7 but do not guarantee uninterrupted service
• We may perform maintenance, updates, or modifications that temporarily affect availability
• Third-party AI services (Google Gemini, xAI Grok) may experience downtime outside our control
• We reserve the right to modify, suspend, or discontinue any feature with reasonable notice

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• SmartBite is provided "as is" without warranties of any kind, express or implied
• We are not liable for any dietary, health, or allergic reactions resulting from following recipes in the App
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

9. Indemnification

You agree to indemnify and hold harmless SmartBite from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

10. Termination

• You may delete your account at any time by contacting support@smarterbite.net
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page. Your continued use of SmartBite after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
